THESE TERMS AND CONDITIONS GOVERN YOUR USE OF THE MANUFACTURING INSTITUTE WEBSITE http://www.manufacturinginstitute.co.uk

PLEASE READ THEM CAREFULLY. WE SUGGEST THAT YOU PRINT AND RETAIN A COPY OF THESE TERMS FOR FUTURE REFERENCE.

1. Introduction

1.1 By accessing The Manufacturing Institute (the "Site") you agree to be bound by all the Terms and Conditions of use and the Privacy Policy (the "Terms") regardless of whether you register [as a member.]

1.2 If you do not accept all the Terms, you should not use the Site.

1.3 We may amend these Terms at any time without prior notice.

1.4 Your continued use of the Site means that you accept any amendments to the Terms.

2. Registration

2.1 In order to access certain parts of the Site and receive electronic newsletters, you will need to register as a member by selecting a membership ID and password. You certify that all information that you provide will be accurate. Any amendments to your details should be e-mailed immediately to info@manufacturinginstitute.co.uk. Your member registration is unique to you and you accept that you are solely responsible for maintaining the confidentiality of your password and membership ID.

3. Our Content

3.1 Except as expressly provided in these Terms, all rights in the material on the Site including any newsletters (together the "Content"), including copyright, trademarks, service marks and database rights, are either owned by or licensed to The Manufacturing Institute or otherwise used by The Manufacturing Institute as permitted by applicable law.

4. Your Content

4.1 The Site may contain discussion forums and other interactive areas (the "Interactive Areas") The Manufacturing Institute does not control or own the information that users post on our Interactive Areas. However, you agree to grant The Manufacturing Institute an unlimited, royalty free licence to republish or otherwise use anything that you post on the Site.

4.2 You are responsible for the content of the material that you post and for any acts that occur through the use of your membership. You agree to use the Site for lawful purposes only. In particular, you warrant that you or anyone using your membership details shall not:
4.2.1 post or transmit any material that you do not have a right to transmit under law (for example, but not limited to, copyright);
4.2.2 post, transmit or link to any information that is obtained in breach of confidence;
4.2.3 post, transmit or link to any content that is obscene, defamatory, threatening, degrading or which discloses private or personal matters concerning any person;
4.2.4 post, transmit or link to sexually explicit material;
4.2.5 post, transmit or link to any advertising, promotional materials or other forms of solicitation, including chain mails or pyramid schemes;
4.2.6 impersonate any person, or entity or misrepresent your affiliation with anyone or entity;
4.2.7 collect or store other users' personal data;
4.2.8 Prevent or restrict the use of the Site by other users;
4.2.9 intentionally violate any other applicable law or regulation while accessing and using our Site;

5. Linking

5.1 You may create a link from your website to the homepage of the Site only, provided that you register as a member and provided that you do not link to the Site from any site containing obscene, defamatory, threatening or degrading material or material that infringes the intellectual property or other rights of any third party or which is otherwise unlawful.

5.2 Linking to a page other than the homepage of the Site (Deeplinking) or presenting the Content of the Site within another website (Framing) is prohibited without the written consent of The Manufacturing Institute.

6. Partners


6.1 The Site/Manufacturing Institute is (supported) by partner organisations whose names appear on the Site and whose own sites can be accessed by hypertext links from this Site. When you activate any of these links, you will leave the Site and The Manufacturing Institute accepts no responsibility for the availability or content of any linked websites.

7. Booking Online


7.1 If you book online for any of our courses or events you will be asked to submit certain personal information together with your credit card details. The Manufacturing Institute is committed to maintaining privacy and the security of the personal data which we receive from you.

8. Right to Cancel and refunds

8.1 If the customer wishes to cancel the contract for any reason, it must send the notice of cancellation in writing to The Manufacturing Institute.

8.2 In the event of cancellation of a short programme (i.e. a programme of less than 6 months duration) by the Customer, a full refund will only be payable if notice of cancellation is received by TPMI at least 21 working days before the commencement of the programme. For a long programme (i.e. a programme of more than 6 months duration) 42 working days notice of cancellation will be required.

8.3 If notice of cancellation for a short programme is received by TPMI less than 21 working days prior to the commencement of the Services, the following cancellation fees shall apply:

14-20 days prior to commencement of the Services 50% of the Fees

7-13 days prior to commencement of the Services 75% of the Fees

Less than 7 days prior to commencement of the Services 100% of the Fees

8.4 If notice of cancellation for a long programme is received by TPMI less than 42 working days prior to the commencement of the Services, the following cancellation fees shall apply:

Date of Receipt of Cancellation Notice by TPMI Cancellation Charge

28-41 days prior to commencement of the Services 50% of the Fees

14-27 days prior to commencement of the Services 75% of the Fees

Less than 14 days prior to commencement of the Services 100% of the Fee

8.5 For the TMI/ERDF Growth Programme, if the Customer wishes to cancel the Contract for any reason, it must send notice of cancellation in writing to TPMI. In the event of cancellation by the Customer, a full refund will only be payable if notice of cancellation is received by TPMI at least 21 working days before the commencement of the programme. If notice of cancellation is received by TPMI less than 21 working days prior to the commencement of the Services, the following cancellation fees shall apply:

7-13 days prior to commencement of the Services 75% of the Fees

Less than 7 days prior to commencement of the Services 100% of the Fees

9. Competitions and Prizes

9.1 The Manufacturing Institute may run competitions, prize draws and promotions on the Site that will be subject to additional terms and conditions applicable to each individual instance and which will be made available at the time of such competitions.

10. Disclaimer of Warranties and Liability

10.1 Whilst we try to make sure that the Content of the Site is accurate, The Manufacturing Institute does not warrant the accuracy, currency or reliability of the Content.

10.2 The Manufacturing Institute does not guarantee that the Content will be technically suitable for viewing on your computer.

10.3 The Manufacturing Institute does not warrant that the Site will be delivered to you uninterrupted, timely, secure or error-free, or that the Site and the server are free or computer viruses or other harmful applications.

10.4 You understand and acknowledge that information posted or transmitted by members/users are the sole responsibility of the person from which the material originated. The Manufacturing Institute accepts no responsibility for the accuracy, completeness, or even the truth of any information posted in our interactive areas by our members/users.

10.5 Any hypertext linked websites are maintained by individuals or entities over which The Manufacturing Institute has no control. When you activate any of these links, you will leave the Site and The Manufacturing Institute accepts no responsibility for the availability or content of any linked websites and shall not be responsible in any way for arrangements regarding goods or services from such linked websites. The links are provided for your convenience and any such link does not imply endorsement by The Manufacturing Institute of a website or any association with the operators of a website.

10.6 Should you use the Site to purchase products or services from our partner organisations any contracts will be exclusively between you and the relevant third party organisation. The Manufacturing Institute shall not be responsible for any costs, claims, damages and liability arising from these, even if the contract was entered into through the Site.

10.7 Except in the case of death or personal injury caused by the negligence of The Manufacturing Institute, neither The Manufacturing Institute, nor any of its directors, employees or representatives will be liable to you or to any third party for damages of any kind arising out of or in connection with the use of this Site.

10.8 The Site contains general information only and not professional advice of any kind. The Manufacturing Institute cannot accept any liability to you for any action you decide to take, or refrain from taking, as a result of information obtained from our Site. The Manufacturing Institute recommends that for specific professional advice you obtain advice from a suitable qualified professional in the area of your enquiry.

11. Indemnities

11.1 You agree to indemnify The Manufacturing Institute against all legal fees, damages and other expenses that may be incurred by The Manufacturing Institute as a result of your breach of any of these Terms.

12. Privacy Policy

12.1 The Manufacturing Institute collects information from users during the membership registration process and, occasionally, at other times. You may register as a member by completing and submitting the online registration form. When you register, we ask for your name and company details including e-mail address.

12.2 The Site complies with the relevant English Data Protection laws. Any personal details that we collect will be dealt with in accordance with the Data Protection Act 1998.

12.3 Unless required by law or any regulatory authority or in order to protect the rights and property of The Manufacturing Institute, The Manufacturing Institute will not sell or transfer your personal data to and third party without your consent.

12.4The Manufacturing Institute reserves the right to store and use members' personal data solely for our own internal purposes.

12.6 The Manufacturing Institute reserves the right to use cookies to identify registered members who return to the site. Cookies enable us to personalise our service to you. If you do not want a cookie, you can always instruct your browser to deny it.

13. Headings

13.1 The paragraph headings in these Terms are used solely for the sake of convenience and shall not have contractual significance.

14. Access outside UK


14.1 The Manufacturing Institute does not represent that the Content or the Site shall be appropriate or available for use outside the United Kingdom. If you access the Site from outside the United Kingdom, it is your responsibility to ensure compliance with any foreign and local laws and requirements.

15 Severability

15.1 If any provision in these Terms is invalid or unenforceable, the remaining provisions will continue in full force and effect.

16 Applicable Law and Dispute Resolution

16.1 These Terms are be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

16.2 If any dispute arises out of these Terms or the use of this Site the parties will attempt to settle it be negotiation. If the dispute has not been settled after 21 days the parties will attempt to settle it by mediation in accordance with the Centre for Dispute Resolution (CEDR) Model Mediation Procedure.
